Terms and Conditions of Service
These Terms and Conditions of Service ("Terms") govern your access to the OptOutDay website and your use of its personal information removal and privacy management services (collectively, the "Services"). OptOutDay ("we," "us," or "our") is operated by Dilangi, Inc., Majuro, Marshall Islands MH96960. "You" and "your" mean the person using the Services.
OptOutDay helps individuals identify and request the removal or suppression of their personal information from supported data broker websites, people-search websites, and similar third-party services. OptOutDay does not offer personal information for sale or license through the Services. You pay for the work involved in managing privacy requests and any monitoring included in your plan.
By accepting these Terms when registering or purchasing Services, you agree to be bound by them. Our Privacy Policy explains how we collect, use, disclose, and retain personal information. Specific service features, coverage, prices, billing intervals, and any promotional terms are disclosed before purchase. A specific purchase term controls over a general provision of these Terms on the same subject, without limiting rights that cannot lawfully be waived.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT REGISTER FOR OR PURCHASE THE SERVICES.
1. Eligibility and Account Responsibilities
You must be at least 18 years old and legally able to enter into this agreement. The Services are intended for adults seeking privacy assistance concerning information held by supported websites serving the United States. Availability depends on your location, the applicable rules, and your plan.
You must provide accurate information, keep it reasonably up to date, protect your account credentials, and notify us promptly of suspected unauthorized access. You may request Services for yourself or another adult only if your plan permits it and you have that person's valid authorization. Payment for another person's plan does not, by itself, authorize you to manage that person's information. We may request evidence of authority before beginning or continuing work.
2. Scope of the Services
Depending on the plan you purchase, the Services may include:
- Searching supported websites for listings that appear to contain your personal information.
- Preparing and submitting removal, deletion, suppression, or opt-out requests through available third-party procedures.
- Following up on submitted requests and recording responses or observable changes.
- Providing progress information and identifying steps that require your participation.
- Periodically checking supported websites for reappearing listings and submitting further requests while an eligible monitoring plan remains active.
The websites covered, number of protected individuals, monitoring frequency, follow-up work, and service duration are those disclosed for your plan. A one-time service does not include continuing monitoring unless expressly stated. We will perform the work described in your plan with reasonable care and skill.
Third-party websites may close, change their procedures, or become inaccessible. We will explain material changes affecting your purchased coverage. Such changes do not eliminate any remedy available to you if we cannot provide a material part of the Services you purchased.
You may submit privacy requests directly to third parties without using OptOutDay. Our fees are for assistance and administration; they do not purchase privacy rights or preferential treatment by a third party.
3. Authorization to Act on Your Behalf
When you enroll an individual and provide the required authorization, you appoint OptOutDay to act on that individual's behalf solely to perform the privacy request and monitoring activities included in the purchased Services. This limited authority allows us to identify relevant listings, submit supported requests, communicate with the receiving websites, and receive responses about those requests.
Where required, we will obtain a separate signed authorization or other documentation before acting as an authorized agent. Acceptance of these Terms alone does not replace additional legal or third-party requirements. A website may require you to verify your identity directly or confirm that you authorized us.
This authorization does not permit us to sell your information, open financial accounts, enter into unrelated contracts, settle legal claims, or act as your general attorney-in-fact. We may use service providers to assist with the authorized work, subject to appropriate confidentiality and data-use restrictions and any additional authorization required by law.
You may revoke this authority at any time by contacting us through the support channels listed below. Once received, revocation ends our authority to make new requests or continue monitoring on your behalf; we will stop that work promptly. Requests already received by third parties may continue through their processes, and we cannot guarantee that they can be recalled. Revoking authority also cancels future renewal of the affected individual's Services; other independently purchased Services remain active unless you cancel them.
4. Information and Verification
To locate the correct records and process requests, we may need information such as your name, previous names, current or former addresses, telephone numbers, email addresses, and links to relevant listings. We will request identity or authority documentation only when reasonably necessary for a specific verification requirement.
You authorize us to disclose the information reasonably necessary to identify the relevant record, establish your authority, and process the request to the receiving website and service providers assisting us. A receiving website may need to retain limited information to document or maintain an opt-out or suppression request. Its handling of information is governed by applicable law and its own privacy practices.
Do not send passwords, full Social Security numbers, payment credentials, or unredacted identity documents through ordinary email. If additional verification is necessary, we will provide instructions for the appropriate submission method. You may decline to supply additional information, but we may be unable to complete the affected request. We will explain the resulting limitation.
You agree to complete reasonably necessary verification steps and respond to requests for clarification. We will not knowingly submit a request for the wrong person or use false information to bypass verification.
5. Removal Outcomes and Limitations
OptOutDay manages requests; the operators of third-party websites control their records and responses. We cannot guarantee that every listing will be found, that every request will be accepted, or that information will be removed within a particular period or remain unavailable permanently. Any estimate we provide is an estimate unless expressly stated to be a contractual commitment.
Deletion, suppression, and opting out are different outcomes. A website may remove a public listing while retaining information internally, or stop selling or sharing information without deleting all records. We will describe the outcome based on the evidence available rather than treating these results as interchangeable.
A submitted request is not a completed removal. A third-party confirmation is not necessarily independent verification of deletion. A listing that we cannot find during a check may still exist elsewhere or become visible again. Status updates reflect the source and time of the relevant observation or response.
Information may reappear when websites refresh their databases or obtain it from other sources. Removal from one website does not remove it from the original source, other websites, search engine caches, backups, or copies already obtained by others. Periodic monitoring, where included, is not continuous monitoring of the entire internet.
Unless expressly included in your purchase, the Services do not cover government or court records, news articles, social media content, search engine de-indexing, dark web monitoring, credit repair, identity theft recovery, or legal proceedings. We cannot require a third party to delete information that it is legally permitted or required to retain.
6. Permitted Use
You may use the Services only for lawful privacy management. You must not impersonate another person, submit forged authorizations, interfere with another person's rights, attempt to remove information without authority, compromise our systems, or use the Services to commit fraud or obstruct lawful proceedings.
OptOutDay does not provide background screening or consumer eligibility reports through the Services. Any listing details or progress reports we provide are for managing your privacy requests and must not be used to evaluate another person's eligibility for employment, housing, credit, insurance, or similar purposes.
7. Personal Information and Service Records
You retain your rights in your personal information. Supplying information to OptOutDay does not transfer ownership of it to us. We use information supplied or located for your requests to provide and support the Services, protect accounts, document authorized activity, and meet applicable legal obligations, as described in our Privacy Policy.
We do not sell personal information collected for the Services or use it to build a people-search directory. We do not share it for cross-context behavioral advertising. Necessary disclosures for request processing, payment processing, hosting, support, security, or legal compliance are described in our Privacy Policy.
We may keep records of authorizations, requests, responses, billing, and support interactions for the purposes and retention periods described in that policy. We apply reasonable safeguards appropriate to the information processed, but no transmission or storage system is completely secure.
Canceling a subscription does not automatically delete your OptOutDay account or all service records. You may separately request account closure or exercise applicable privacy rights through the methods described in our Privacy Policy. We will delete or retain information in accordance with that policy and applicable law, including any necessary retention exceptions.
8. Fees and Payment
Before you purchase, we will disclose the price, scope, service duration, applicable taxes or mandatory charges, and whether the purchase is one-time or recurring. Prices are in US dollars unless expressly stated otherwise. You authorize the charges you expressly accept at checkout.
A one-time purchase is charged once and does not automatically become a subscription. A subscription is prepaid for the billing period disclosed at purchase. Fees compensate OptOutDay for the work included in your plan, rather than for the purchase of information or a guaranteed number of deletions, unless your offer expressly provides otherwise.
We may change prices for future purchases or renewals after providing any required advance notice and obtaining any required consent. A price change will not retroactively increase the charge for a period already paid for.
9. Trials and Automatic Renewal
If offered, a free or discounted trial will state its duration, included features, cancellation deadline and applicable time zone, subsequent price, and billing frequency before enrollment. A trial converts to a paid subscription only if that conversion was clearly disclosed and you expressly consented to recurring charges.
If you select and expressly authorize an automatically renewing subscription, it renews for the billing period disclosed at purchase until canceled. We will provide renewal or trial notices where required by law. You can prevent the next charge by canceling before the next billing date or the trial deadline disclosed to you.
10. Cancellation
You may cancel automatic renewal at any time through the "Membership" section accessible from your account profile or by contacting Customer Service using the details below. Online cancellation does not require a telephone call. We will confirm your cancellation, and no further renewal charges will be made for the canceled plan.
Unless you request an immediate stop, revoke our authorization, or close your account, your purchased Services continue until the end of the current paid billing period. This applies to the actual billing period, including an annual plan, rather than only the current calendar month. After that period, new requests, follow-up work, and monitoring end unless separately agreed. Existing third-party suppression or opt-out choices are not withdrawn merely because you cancel.
If you encounter a cancellation error, contact Customer Service promptly. A failure in our cancellation system will not invalidate a timely cancellation request that we can verify. Cancellation of renewal and requests for refunds are handled separately as described below.
11. Refund Policy
Except where required by law, expressly promised in your purchase terms, or provided below, payments are non-refundable once the purchased work has begun, and cancellation does not create a right to a prorated refund for a partially used billing period. A third party's refusal or delay does not by itself establish that OptOutDay failed to perform the request-management work you purchased.
If you are dissatisfied, please contact us within 30 days of purchase so we can investigate and discuss an appropriate resolution. This requested contact period does not shorten any statutory claim, dispute, or refund period. If we do not provide a material part of the purchased Services, we will offer to remedy the failure or provide an appropriate refund for the unprovided portion. Duplicate or erroneous charges will be corrected.
Nothing in these Terms limits mandatory cancellation, withdrawal, refund, charge-dispute, or other consumer rights.
12. Communications
We may send account, verification, request-status, billing, security, and other communications needed to provide the Services. Optional marketing communications will be handled in accordance with applicable consent requirements. You may unsubscribe from marketing messages without canceling the Services; necessary account and service communications may continue.
13. Website and Materials
OptOutDay and its licensors retain rights in the website, software, branding, and original service materials. We grant you a limited, non-exclusive, non-transferable right to access them for your authorized use of the Services. You may keep your own progress reports and share them with your authorized advisers. This section does not give us ownership of your personal information or restrict your statutory access rights.
You must not copy or resell the Services, bypass access controls, or use automated tools to disrupt the website or extract other users' information. Any restriction on reverse engineering applies only to the extent permitted by law.
14. Suspension and Termination
These Terms apply while you use the Services. We may suspend or terminate access for material misuse, lack of valid authorization, nonpayment, a significant security risk, or a legal requirement. Where reasonably practicable, we will explain the reason and allow you to resolve it before termination. Immediate action may be necessary to prevent harm or comply with law.
If we discontinue paid Services for reasons unrelated to your breach, we will refund the prepaid amount attributable to the unprovided portion. Termination ends future work and renewals for the affected Services. Our limited authority to act on your behalf ends when those Services end, except for any separately authorized completion work.
Provisions concerning accrued payment obligations, permitted retention, intellectual property, liability, and dispute resolution survive only to the extent needed to give them effect. Termination does not extend our authority to submit privacy requests.
15. Disclaimers and Liability
OptOutDay is not a law firm and does not provide legal advice or representation in disputes with third parties. The Services do not guarantee anonymity, protection against identity theft, or the removal of every instance of your personal information.
To the extent permitted by applicable law, and except for our express commitments and any mandatory warranties or standards of care, the website and Services are provided "as is" and "as available." Third-party outages, changes, and delays may affect performance. We remain responsible for performing our own obligations under these Terms.
To the extent permitted by applicable law, neither party is liable to the other for indirect or consequential losses that were not reasonably foreseeable when the agreement was made. OptOutDay's aggregate liability arising from the Services will not exceed the greater of US $100 or the fees you paid for the affected Services in the 12 months before the event giving rise to the claim.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or liability that cannot lawfully be excluded or limited. They do not reduce refund obligations or non-waivable privacy and consumer rights. Where a limitation is prohibited or unenforceable, including where applicable to New Jersey residents, it does not apply.
16. Changes to These Terms
The current Terms are available at https://optoutday.com/page/terms. We will identify the effective date of revisions and provide reasonable advance notice of material changes affecting existing customers. Changes apply prospectively. Where required, we will obtain your consent before applying a change. An update to these Terms does not by itself authorize new uses of your personal information or new recurring charges.
17. Consumer Rights and Disputes
Please contact us first if you have a complaint so we can try to resolve it. Doing so is not a prerequisite to exercising a legal right or contacting a regulator. Nothing in these Terms requires mandatory arbitration, waives class proceedings, or prevents you from bringing a claim in a court with jurisdiction under applicable law.
If a provision is unenforceable, it will apply only to the extent permitted, and the remainder of these Terms will remain effective. These Terms do not exclude protections that apply to you under mandatory consumer or privacy law.
